The Law on Competition was enacted in 2021 in order to govern any activities that prevent, restrict or distort competition. Those activities are 1) agreements which prevent, restrict or distort competition in form of either horizontal agreements or vertical agreements; 2) abuse of dominant market position; and 3) business combinations. Technically, the determination and classification of breach is based on the consequences of preventing, restricting or distorting competition by either per se rule or rule of reason subject to the decision of the Cambodia Competition Commission ("CCC").
As for the implementation and enforcement of the Law on Competition, the Royal Government of Cambodia, the Ministry of Commerce and the CCC have issued subsequent regulations and decisions on investigation and negotiated settlement in 2022 and business combination in 2023. Therefore, the affected companies as well as associations are keen to learn and understand more about such law and its subsequent regulations in order to avoid any unintentional breach as well as to fully comply with any applicable provisions.
